General Terms and Conditions (AGB's) for the online trade Fabrics & More (April 2019)

1. scope of application
The online shop Fabrics & More is operated by Interior Showroom, owner Jacqueline Koepfer (hereinafter: Interior Showroom) in Zurich. Deliveries via Fabrics & More are made exclusively on the basis of these GTCs. By placing an order in the online shop, the customer (hereinafter: the customer) accepts these GTC. The GTC's are valid in the respective current version at the time of the conclusion of the contract.

2. orders
The contractual relationship is established by the client's order and the electronic acceptance of this order by Fabrics & More.

After payment of the price of the goods, the customer receives an order confirmation.

The prices offered or confirmed are always gross prices (incl. VAT), in Swiss francs. If delivery to an address in Switzerland is requested, the stated flat-rate shipping fee is a component of the gross price. Delivery abroad requires a separate agreement.

3. delivery period / availability
If the agreed or confirmed delivery date cannot be met, the customer will be informed of this and the subsequent receipt of goods.

As a rule, an item will be dispatched within 15 days of the date of the order confirmation. If this delivery period is exceeded, the customer will not be entitled to any claims against Interior Showroom for delay. As soon as it is definitively established that an item cannot be delivered, Interior Showroom will inform the customer immediately and arrange for the refund of the purchase price paid by the customer.

If an order cannot be placed within 12 weeks of the date of the order confirmation, the customer is entitled to set Interior Showroom a deadline of at least 15 days to deliver the goods. If delivery cannot be made within this period, the customer is entitled to withdraw from the contract in return for a refund of the purchase price paid, without any further mutual cost consequences with regard to the undelivered goods.

4. benefit and risk
Benefit and risk shall pass to the customer upon dispatch of the goods from Interior Showroom's domicile or, in the case of direct delivery to the customer, from the supplier's domicile.

5. complaints / time limit for complaints
Please check the delivered items carefully immediately after receipt, in particular with regard to colour, length or any defects. The customer must notify any complaints in writing within 5 working days at the latest, in the case of hidden defects immediately after their discovery, after receipt of the delivery. The notification shall specify the exact nature of the defect complained of. After expiry of the five working days, the delivered product shall be deemed to have been approved by the customer in accordance with Art. 201 of the Swiss Code of Obligations. No complaint shall be accepted after the goods have been cut or processed.

6. notes on use
The specifications in the online shop (incl. fabric widths) are approximate values and may deviate slightly during production. Deviations in length and width of 3-5% are within the tolerance range.
Dimensional stability: Each fabric has its own dimensional structure depending on the composition and fabric structure; corresponding deviations do not justify a complaint. Before using the fabric as a wall covering or as a curtain, its suitability must be tested (with particular regard to composition, texture, nature of the supporting surface, climatic conditions). In the case of a fabric made of viscose (a man-made fibre originally derived from cellulose), it should be noted that it tends to absorb moisture and may change shape as a result. Dry cleaning can also lead to shrinkage of the shape.
Washable fabrics: If the fabric is washable according to the product description, it is recommended to wash it before further processing. Any shrinkage of the fabric must be taken into account. A spin cycle should not exceed 600 revolutions/minute.
Velours: Light refractions caused by use as well as pressure marks, shading or wrinkles caused by transport do not justify a complaint.
Wall coverings (wallpapers): Due to the craftsmanship, there may be differences in wall coverings between different batches, but also within one roll. Such differences are part of the type of production and do not justify a complaint. It is recommended to check each roll for defects or different batches before processing and to check for the occurrence of problems during the processing of each sheet. Further processing must be stopped immediately if unacceptable results occur. A justified complaint will only be accepted up to the processing of a maximum of 3 webs; apart from the replacement of the defective goods, any damages (such as labour or downtime costs) will not be accepted.
Special treatments by the customer: Special treatments (such as impregnation against fire or stains) are the responsibility of the customer.
Order of samples
When ordering a sample in advance, it cannot be guaranteed that the subsequently ordered fabric comes from the same production and that there are no colour discrepancies. To avoid discrepancies, we recommend stock-cutting or asking in our shop.

7. manufacturer's warranty / disclaimer of warranty
Provided that the period for lodging a complaint pursuant to clause 5 and the instructions for use pursuant to clause 6 of these GTC are complied with and a justified complaint is made, Interior Showroom will support the customer in exercising her rights during and within the scope of any manufacturer's or supplier's warranty. Defects notified in good time will be remedied by means of a new delivery, provided that this is covered by the manufacturer's or supplier's warranty, if any, and the fabric is still available. Further claims by the customer against Interior Showroom are excluded. In particular, there is no guarantee of light fastness. Any warranty is excluded from the outset if the defect or damage was caused by improper use or other reasons for which the customer is responsible.

In all other respects, all legal and material warranty claims by the customer against Interior Showroom are expressly excluded. In the event of non-compliance with the requirements of sections 5 and 6 of these GTC, the customer will in principle have no claims whatsoever against Interior Showroom.

8 Liability
Fabrics & More or Interior Showroom is liable for breach of contractual and non-contractual obligations in the event of damage caused intentionally or by gross negligence. Any further liability, in particular liability for auxiliary persons (Art. 101 OR) is excluded.

9. data protection
The use of personal data is regulated in the data protection declaration [link]. The data protection declaration is an integral and binding part of these GTC.

10 Jurisdiction
The place of jurisdiction is Zurich. Fabrics & More or Interior Showroom reserves the right to assert its rights at the domicile of the client or before any other competent court.

11 Applicable law
The contractual relationship, including these GTC, shall be governed by Swiss substantive law, excluding the United Nations Convention on Contracts for the International Sale of Goods ("Vienna Sales Convention").
